Terms of Service (ToS)

Preamble

These Terms of Service (hereinafter "ToS") govern access to and use of the Omiros service (hereinafter "the Service"), an online platform for Twitch streamers enabling the creation of personalised profile pages, the management of automated announcements via Discord and Twitch bots, and access to tools for monitoring their streaming activity.

Accessing the Service constitutes full and unconditional acceptance of these ToS. Any person who does not accept these ToS must refrain from using the Service.

Omiros is currently in public beta. Service interruptions, anomalies, or malfunctions may occur. Using the Service during this phase implies acceptance of these particular conditions.

Article 1 — Definitions

  • "Service": the Omiros platform accessible at omiros.me, including the web interface, associated APIs, the Omiros Discord bot, and the Omiros Twitch bot.
  • "User": any natural or legal person who creates an account on the Service.
  • "Account": a personal space created by the User allowing access to the Service's features according to the subscribed plan.
  • "Bento Page": the User's customisable public profile page, accessible to any visitor without authentication.
  • "Discord Bot": an optional module enabling Omiros to send automated announcements (live, offline) to a Discord server connected to the User's account.
  • "Twitch Bot": an optional module (Pro plan only) enabling Omiros to interact with the chat of the User's Twitch channel.
  • "Free Plan": free offer with access to basic features.
  • "Pro Plan": paid offer at €4.99 per month, unlocking advanced features including the Twitch Bot.
  • "User Content": any content (text, images, links, information) published by the User on their Bento Page or within the Service.

Article 2 — Access to the Service and Account Creation

Access to the Service is open to any natural person aged at least 13 years. Users aged 13 to 15 inclusive must have prior authorisation from their legal representative to use the Service. By creating an account, the User declares that they meet this requirement. Omiros cannot be held liable for a false declaration by the User regarding their age.

Registration is possible via three methods:

  • Email and password
  • Sign in with a Google account (OAuth)
  • Sign in with a Twitch account (OAuth)

The User undertakes to provide accurate information upon registration and to keep it up to date. Only one account is permitted per person. Omiros reserves the right to suspend or delete any account whose authenticity is in doubt.

Signing in via Twitch OAuth does not constitute a standalone authentication method; it also enables Omiros to access the User's Twitch data and features within the scope of the granted permissions.

Article 3 — Third-Party Service Connections (Discord and Twitch)

The Service offers integration with the User's Discord and Twitch accounts to enable additional features.

Discord connection (Omiros Bot):

By inviting the Omiros bot to their Discord server, the User authorises Omiros to access the server's identifier, selected channels, and to publish automated announcements there. The User may disconnect the bot at any time from their Discord server via the dedicated command, which triggers the immediate deletion of associated Discord data from Omiros's database.

Twitch connection (Free plan):

During registration, the User may connect their Twitch account. The permissions requested at this stage are limited to reading channel data (subscribers, goals, polls, etc.) and reading the email. The full list of permissions is presented to the User at the time of the consent request.

Extended Twitch connection (Twitch Bot — Pro Plan):

Activating the Twitch Bot requires a second OAuth authorisation request with extended permissions, including in particular chat management, moderators, clips, and broadcast settings. The exhaustive list of permissions is presented to the User before any consent is given. These permissions allow the Twitch Bot to act on behalf of the User on their channel.

The User may revoke these permissions at any time from their Omiros account settings. Disconnecting Twitch does not delete the Omiros account but disables features that depend on Twitch.

Article 4 — Bento Page and Public Content

Each User has a public Bento Page, visible to any visitor without authentication. The User is solely responsible for the content they publish on their page.

The User agrees not to publish on their Bento Page or within the Service:

  • any unlawful, defamatory, abusive, obscene, pornographic, violent, or human dignity-undermining content;
  • any content infringing third-party rights (intellectual property, privacy, personal data);
  • any content promoting illegal activities, illicit substances, or unauthorised gambling;
  • any links redirecting to malicious websites, scams, phishing systems, or any fraudulent content;
  • any hateful content based on origin, religion, gender, sexual orientation, or any other discriminatory criterion.

Omiros has implemented technical filtering measures to limit the insertion of fraudulent links. When a link could not be automatically verified, a warning is displayed to visitors indicating that Omiros was unable to confirm its compliance.

Omiros reserves the right, without obligation or prior notice, to render invisible or disable any Bento Page whose content is manifestly contrary to these ToS. The User concerned will be notified by email as soon as possible.

Article 5 — Reporting Unlawful Content

Any visitor may report unlawful content published on the Service by contacting Omiros at the support email address indicated in the Legal Notice. Omiros undertakes to process every report as soon as possible.

In the event of a serious and proven violation of these ToS (fraud, child sexual abuse material, incitement to hatred, etc.), Omiros reserves the right to immediately and permanently delete the account concerned, without prior notice and without entitlement to a refund, and to make any required legal reports to the competent authorities.

Article 6 — Omiros's Liability

  • Omiros provides the Service on an as-is basis, without any guarantee of freedom from defects or interruption. During the beta phase, malfunctions are to be expected. Omiros shall not be held liable for direct or indirect damages resulting from Service unavailability, data loss, or a bug.
  • Omiros shall not be held liable for content published by users on their Bento Pages, provided it removes any unlawful content brought to its attention.
  • Omiros shall not be held liable for damages suffered by third parties as a result of links, promotions, or information published by a User on their Bento Page. The criminal and civil liability of the streamer who owns the account is solely engaged for any damage caused to visitors or third parties through such content.
  • Omiros shall not be held liable for actions carried out via the Twitch Bot within the scope of the permissions granted by the User.

Article 7 — Hyperlinks

The Service may contain links to third-party websites. Omiros shall not be held liable for the content of such websites, their availability, or their personal data practices. Browsing these websites is done entirely at the User's own risk.

Article 8 — Intellectual Property

  • The Service, including its source code, design, logos, visual identity, and architecture, is the exclusive property of Omiros and its operator, protected by intellectual property law.
  • The User retains ownership of their User Content. They grant Omiros a worldwide, non-exclusive, royalty-free licence solely for the purposes of displaying, storing, and providing the Service.
  • Any reproduction, extraction, imitation, or exploitation of the Service or its components for commercial or non-commercial purposes, without the prior written authorisation of Omiros, is prohibited.

Article 9 — Account Suspension and Termination

  • The User may delete their account at any time from the Service settings. Deletion results in the immediate deactivation of the account and deletion of data in accordance with the terms described in the Privacy Policy.
  • Omiros reserves the right to temporarily suspend or permanently terminate any account in the event of a violation of these ToS, without prior notice in serious cases. The User will be notified by email. In the event of suspension pending investigation, the account is temporarily deactivated pending the outcome of the review. If the violation is confirmed, the account is permanently deleted. No refund will be issued in the event of termination for cause.

Article 10 — Amendments to the ToS

Omiros reserves the right to amend these ToS at any time. Users will be informed of any material change by email or via a notification within the Service. Continued use of the Service after notification constitutes acceptance of the updated ToS.

Article 11 — Governing Law and Jurisdiction

These ToS are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent courts, subject to the mandatory rules applicable to consumers residing in another European Union member state.
